Jackie Griffin-Doherty, Chair of the Pinellas County Juvenile Justice Council:

You allowed the 10/27/05 meeting of the Pinellas County Juvenile Justice Council to adjourn without a vote of the assembly for proper adjournment. In doing so, you also permitted a pending motion (appeal the order [decision] of the Chair) to remain as a Council issue that was not properly disposed of, despite objections and queries of 'point of order' and 'parliamentary inquiry'.

You, as Chair, threatened to end the Council meeting. You, as Chair, threatened to have members removed from the Council meeting.

I request an explanation - a 'parliamentary inquiry' - as to the remedy of this Council disorder.

The Council Chair must be fair and impartial while conducting Council meetings. While conducting Council business, the rights of the minority must be protected.

Hello Jim Coats,

We met on June 10, 2004, prior to your election as Sheriff of Pinellas County. At that time, you conveyed an interest in 'juvenile justice'. Early this year (January 2005) you were elected by the Pinellas County Juvenile Justice Council to be a member of the Circuit 6 Juvenile Justice Board. I am a member of the Council and I voted for you! I am disappointed that you have not attended any meeting of the Circuit 6 Juvenile Justice Board since your election to the Board, nor have you attended any meeting of the Pinellas County Juvenile Justice Council. If you have no interest in being a member of the Circuit 6 Juvenile Justice Board, I request that you submit your resignation.

Ed Short, I also would like to thank you for making us aware of the recent changes in the Statutes. Judy Smith with the Clearwater Police made an inquiry at the Sept. JJC meeting as to possible changes in the Statutes. Pat McGhee stated that there were no changes in the statutes. The chair [Jackie Griffin-Doherty] did not say anything and has not notified this council of any changes in legal manadates. I went by the current information provided in the bylaws of this council. I am glad you see the you to are being active in keeping abreast of the legal mandates when our chair is unable to or incapable of doing so. We all need do the best we can to see this council is opperating its business within proper rules of order instead of like a kangaroo court characterized by irresponsible, perverted, and irregular procedures that have been exhibited by the chair of this council.

 

  ARTICLE II – MEMBERSHIP

2.1 Council Membership Council membership must include, but is not limited to the following entities as established in Section 985.4135 (10), Florida Statutes (2000):

2.1.1 Representatives of the school district, which may include elected school board officials, the school superintendent, school or district administrators, teachers and counselors;

5.2.2 Chair—the Chair shall be the Principal executive officer of the Council and shall supervise all business and affairs of the Council. The Chair shall:

I am so glad that someone else is taking the initiative to look up these statutes!!! And a LEO!  Thank you for your research!

The referenced statute (FSS 985.4135) was amended earlier this year, during the 2005 legislative session.

So, up until about 5 months ago, there was mandatory representation from the various entities as listed in the Statute.  In deference to the Council member who brought up this issue, this Council did not have mandated representation from DOC and local governmental municipalities for most of the last few years;  representation from the schools and the judicial system has been sporadic.

See below excerpts of Statute 985.4135(10) where the wording changed from MUST (in 2004) to MAY (in 2005).

I recall that Circuit 6 Board member Paul McClintock (Pasco representative) initiated this legislative change because as he conveyed last year 'the statute wording should be MAY instead of MUST because people can't be forced to attend'.

I think Council members should review the entire 2005 Statute to see if there are any other changes.  See link below.

While this statute change lets certain government representatives 'off the hook' from being involved, it will possibly help to get rid of some of the non-participants who just sit through Council meetings because they were mandated to be represented (at taxpayer expense!).

Next, wording in the DJJ grant contracts will hopefully change, so that grant recipients are not 'required to participate in Council meetings', especially those who just attend the meetings but don't desire to participate.

With the allegation made that the school board (Nancy Zambito) was in violation of State Statute by not attending the Juvenile Justice Council meetings I felt obligated to once again look at the Staute that covers the Juvenile Justice Council.  Per FSS 985.4135 para10, the statute  reads:  "Membership of the juvenile justice county councils, or juvenile justice circuit boards established under subsection (9), may include representatives from the following entities:".  I believe the key word here is MAY.

The rest of paragraph 10 reads:
a) Representatives from the school district, which may include elected school board officials, the school superintendent, school or district administrators, teachers, and counselors.
(b) Representatives of the board of county commissioners.
(c) Representatives of the governing bodies of local municipalities within the county.
(d) A representative of the corresponding circuit or regional entity of the Department of Children and Family Services.
(e) Representatives of local law enforcement agencies, including the sheriff or the sheriff's designee.
(f) Representatives of the judicial system.
(g) Representatives of the business community.
(h) Representatives of other interested officials, groups, or entities, including, but not limited to, a children's services council, public or private providers of juvenile justice programs and services, students, parents, and advocates. Private providers of juvenile justice programs may not exceed one-third of the voting membership.
(i) Representatives of the faith community.
(j) Representatives of victim-service programs and victims of crimes.
(k) Representatives of the Department of Corrections.

My interpretation of paragraph ten is that representatives mentioned in sub-paragraph a - k MAY become members not SHALL become members.  I was greatly concerned with the comment I heard reference certain representatives being mandated to participate in the Juvenile Justice Council and that it was a violation of state statute if they didn't. Please advise if you are aware of any other Florida State Statute that states otherwise

The board will act as a jury for youths accused of crimes, giving them a chance to right wrongs without a criminal record. "One good playground fight can generate 30 cases," [COMPASS Manager Vance Arnett] said. If prosecutors think the child will successfully complete the program, a letter is sent to the parents. If the parents and child agree, the kid goes into COMPASS.
